Session Overview

2:00pm Systemising Advice Legal practice is all about information communication, use and management. The Digital Paradigm enables improved and efficient use of information systems to commoditise basic and repetitive advice common to many legal issues. Legal Expert Systems – a subset of Artificial Intelligence – provide further opportunities to develop advice giving processes and systems. This presentation will discuss how Legal Expert Systems can be deployed, how they can be created and their possible application beyond the law office and in the Court system, thus enhancing access to justice. Judge David Harvey Evolution of Damages for Breach of Contact Two important recent decisions of the United Kingdom Supreme Court shed much light on the law of assessment of damages for breach of contract where what would otherwise appear to be a loss has been avoided by the receipt of a benefit. The Court examined whether the benefit was merely collateral or was closely enough related to the loss to amount to an avoidance of that loss. This presentation will examine the two cases and provide some comments on their reasoning and applicability in New Zealand. The cases are Swynson Ltd v Lowick Rose LLP [2017] UKSC 32 (reported at [2017] 2 WLR 1161 and Globalia Business Travel SAU of Spain v Fulton Shipping Inc of Panama (UKSC decision pending on appeal from [2016] 1 WLR 2540; [2015] EWCA Civ 1299).
